The U.S Supreme Court discussed generic Reglan with the Obama Administration this week. Generic drug manufacturers argue that the federal law covers them from state lawsuits.
This request comes from an appeal that generic drug manufacturers filed claiming that they are immune from any state lawsuits. Reglan was approved by the FDA for short term use but was issued with a black box warning, the highest warning level because the drug and its generic forms have been linked to tardive dyskinesia.
Now generic manufacturers are appealing an Eight Circuit Court decision that drug manufacturers are responsible for changing the labels on products when safety information becomes available despite the fact that the FDA has to approve the labels.
